The fundamental reason why the government should not decide who is legal to employ is because it violates individuals' right to pursue their own happiness - to follow their own self-interest. This occurs through the violation of property rights. It tells businesses and individuals that they are not free to enter into employment contracts. It is important to remember that businesses are own by individuals so when you violate "business rights" you necessarily violate individual rights. So when the government uses force to tell businesses that they cannot hire someone, they violate individual rights. It is appropriate, however, for the government to, for example, bar a school from hiring a convicted child rapist (not that it will be in the school's self interest to ever hire such a person). cab21 Posted May 10, 2013 Author Report Share Posted May 10, 2013 (edited) if someone has a court sentence that says other's can't hire the person, that sounds like a employment law. the law is going to have to check on business and who the business hires, if this is to be enforced. it makes it easy to mandate business use e-varify, national id, or some other electronic tracking device on everyone if business are responsible to law for enforcing sentences. i think it's better for a business to choose it's own vetting process, and take the risk and the responsibility in a free market.
